We provide branding, web design, marketing collateral, photography/videography, and digital marketing services to small and mid-sized businesses. These terms govern all use of our website (https://cutyourbrakes.com), contact forms, booking tools, consultations, and any services or deliverables we provide.
 

2. Consultations & Bookings

We offer paid consultations prior to beginning most projects. In some cases, at our discretion, the consultation fee may be waived or credited toward the final project total. Booking a consultation does not guarantee a working relationship or service agreement.

3. Project Engagement & Scope

All projects begin with a consultation or discovery call. Services, timelines, pricing, and deliverables will be clearly outlined in a formal proposal or agreement before any work begins. Work does not commence until both parties have agreed to the scope and payment terms.

These platforms have their own privacy policies, which we recommend reviewing.
 

4. Payments & Refunds

We require full or partial payment up front, depending on the scope of work. Payment details will be clearly stated in your proposal or invoice.

We reserve the right to issue refunds at our discretion in situations where we are unable to fulfill the agreed-upon services or if a significant error has occurred on our end. Due to the nature of custom and digital work, all other payments are non-refundable once work has begun.
 

5. Digital Products

From time to time, we may offer digital products (such as templates, e-books, or design assets) for purchase or free download. These products are licensed for personal or business use only and may not be resold, redistributed, or claimed as your own work.

Unless otherwise stated, all digital product sales are final.
 

6. Client Responsibilities

You agree to provide all requested materials (such as logos, content, brand guidelines, and approvals) in a timely manner. Delays in client communication or asset delivery may affect timelines and deadlines.
 

7. Intellectual Property

Unless otherwise agreed in writing, all original work created by us (including designs, websites, marketing materials, and digital assets) is the intellectual property of No Brakes Web Design and Marketing until full payment is received.
 

After full payment, you will receive the agreed-upon usage rights to the final deliverables.
 

We reserve the right to showcase completed work in our portfolio or for promotional purposes unless otherwise agreed in writing.

8. Limitation of Liability

We do our best to ensure that all work is professional, functional, and accurate. However, we are not responsible for:

• Technical issues beyond our control (e.g., third-party hosting errors, browser compatibility problems)

• Performance of third-party platforms (e.g., social media, ad networks)

• Client misuse or alteration of final deliverables
   

You agree to use our services at your own discretion and risk.

 

9. Cancellations

If you need to cancel a scheduled consultation or meeting, we ask that you provide as much notice as possible. Missed appointments or frequent last-minute cancellations may affect future bookings.
 

10. Governing Law

These terms are governed by the laws of the State of Georgia, USA. Any disputes arising from these terms shall be resolved in the appropriate courts of Georgia.
 

11. Changes to Terms

We may update these Terms of Service from time to time. The latest version will always be available on our website. Continued use of our site or services after changes are posted constitutes acceptance of the updated terms.
